1. Introduction and Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Afterimages OU, a company registered in Estonia with registration number 16195804 ("Afterimages," "Company," "we," "us," or "our"), governing your access to and use of the Hybrid Photography Plugin and all related services, APIs, and applications (collectively, the "Service").

BY CREATING AN ACCOUNT, ACCESSING, OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICE.

2. Service Description

The Hybrid Photography Plugin is a software plugin for Capture One that enables AI-powered image editing through various workflows, including but not limited to:

• Preset-based image transformation
• Object removal from images
• Location/background changes
• Camera angle adjustments
• Relighting and lighting modifications
• Custom prompt-based editing
• Image upscaling (2K to 4K, 4K to 8K)

3. Eligibility and Account Registration

3.1 Age Requirements

You must be at least eighteen (18) years of age to create an account and use the Service.

3.2 Account Creation

To use the Service, you must create an account using a valid email address. You agree to provide accurate, current, and complete registration information.

3.3 One Account Per User

Each user may maintain only one (1) active account. Creating multiple accounts is strictly prohibited.

4. Credits and Payment

4.1 Credit-Based System

The Service operates on a credit-based payment system:

4.2 Non-Refundable Credits

ALL CREDIT PURCHASES ARE FINAL AND NON-REFUNDABLE, except as required by applicable law. Credits do not expire while your account remains active.

4.3 Credit Refunds for Failed Operations

If an operation fails completely and no output is generated, credits will be automatically refunded to your account.

5. User Content and Rights

5.1 Ownership

You retain all ownership rights to your original User Content. We do not claim ownership of your images. The processed output generated by the Service is also your property.

5.2 License Grant

By uploading User Content, you grant Afterimages a non-exclusive, worldwide, royalty-free license to store, copy, and process your content for the purpose of providing the Service.

5.3 User Representations

You represent and warrant that you own or have authorization for all content you upload, including consent from any identifiable individuals.

6. Acceptable Use Policy

You may not use the Service to create content that is:

• Pornographic or sexually explicit
• Depicting graphic violence
• Promoting hatred or discrimination
• Designed to harass or intimidate
• Illegal or promoting illegal activity
• Deceptive or misleading (deepfakes intended to harm)
• Infringing intellectual property rights

7. Third-Party AI Providers

The Service utilizes third-party AI providers including Google (Gemini), Replicate, and Wavespeed. Your content is transmitted to these providers for processing.

Important: We do not use your User Content to train our own AI models.

8. Data Retention

• Uploaded images: Deleted within 24-48 hours after processing
• Generated images: Stored for 30 days, then automatically deleted
• Account data: Retained as long as account is active

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not warrant the accuracy, quality, or suitability of AI-generated outputs.

10. Limitation of Liability

Our total aggregate liability shall not exceed the greater of amounts paid to us in the twelve months preceding the claim or one hundred euros (€100).

11. Governing Law

These Terms shall be governed by the laws of the Republic of Estonia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Harju County, Estonia.
